Q: We made a man redundant nine months ago but now want to re-employ him. How do we stand, particularly with regard to his redundancy pay? And what is his continuity of service?

A: You now treat this man in the same way as anyone else you engage. Nine months ago you ended his employment and made him a redundancy payment and that ended that relationship totally. You do not recover the redundancy pay. You now start again and his continuity of service dates from now.
