HR Tip: You certainly can do so by stating clearly in the offer letter: "This offer of employment is made subject to our receiving two satisfactory references, one of which must be from your current/most recent employer." You alone are entitled to determine whether or not a reference is satisfactory.

Offers subject to references
The wording we use is very similar but we state “This offer of employment is made subject to receipt of two references satisfactory to the Company…. This removes any ambiguity as to who determines whether the reference is satisfactory.
