Q: "One of our employees started a fight in a local pub and broke a lot of furniture. Can we discipline him?"

A: Probably not. The acid test really is whether the behaviour is likely to jeopardise seriously the reputation and performance of the organisation. This is only likely to be the case if it involved a senior employee whose behaviour was given wide publicity. Otherwise you could discipline the employee only if the incident took place at a company function in that pub.
