Restructure - do they have to interview

restructure & chosen to change job - no interview

Didn't find your answer?

Hi, the company I work for announced restructure and our department would change from 3 team leaders & 3 senior analysts to 2 team leaders and 4 seniors.  I'm one of the 3 team leaders i'm part time, I've been approached to move down to senior analyst level, I thought they would have to invite us to interview for the 2 team leader jobs so selection was fair, not just make a decision who fits best without discussion.

First of all you need to be totally sure they haven't also asked the other Team Leaders the same thing. Other than that politely enquire how they are planning on following a fair process. They can't use part-time as a criteria. The trick is to talk to them & if you want to still be a Team Leader to let them know.

Oh, forgot to say re using Part Time as a criteria. If you are female (forgive me if this isn't relevant), you could argue that if they do use your part-time hours as the criteria that it is indirect discrimination in that it may be mostly women that work part-time hours. This may or may not be relevant depending on your situation.
It all boils down to having that truthful conversation with them - you should go through a consultation process anyway and you do need to be sure that they haven't asked all the Team Leaders if they would like to take the other role. Good luck and let us know how you get on.
