We deducted approx £100 from an employee because a help desk phone was used to phone Gambia. We believed this man was
responsible for the calls but this could not be proved. However he was responsible for signing out the phones. A couple of weeks later
we lost the contract and the employee TUPEd over to a new company. They have informed me that the phone continued to be used and they have found the culprit. He has now been dismissed and we have been asked to reimburse the first employe. My managers are not keen to do this as they say he may not have made the calls but was responsile for looking after them. If we do not pay it back, do you think he would have a case to take us to Tribunal.
