My company is merging later this year and my role will no longer exist. I was offered the opportunity to be interviewed for a role in the new company after a ‘job matching’ process but decided that I did not want to be considered as I did not consider the new role to be suitable alternative employment as it has more responsibility and takes on 2 new areas of work that I am not currently responsible for.

My company is taking the view that although I was never made a formal offer of employment, by not going for the interview I have effectively resigned and they are refusing to consider redundancy.

My company so far refuses to put anything in writing, has not followed its own procedures and has not carried out any formal consultation with me?

Have I been made redundant or by choosing not to be considered for the role in the new company have I resigned?
