my son has worked for his company for 3 yrs, last week all employees were sent a letter informing them the company was going into administration.  Then salaries were due last week but were not paid which is breach of contract and amounts to constructive dismissal.  My son has received a job offer but thinks he can’t resign till he receives a formal redundancy notice, however the company seems to be delaying issuing these, there are around 20 employees.  I think they are hoping people will resign as then this would presumably reduce the redundancy liability as if they resign this would mean they would lose their entitlement to redundancy, is this correct though as there has been a breach of contract as salaries have not paid?
